Summary: you must be 18 or older. Use the service responsibly, review AI-assisted outputs before publishing, and ensure you have rights to your inputs and public content.

Introduction

Welcome to Talevo. These Terms of Service ("Terms") govern your access to and use of the Talevo platform—a user-generated content ("UGC") service for AI-assisted novels, interactive adventure scripts, images, publishing, discovery, and related community features.

覃鲲鹏 (individual operator, Australia) operates Talevo as an individual service provider based in Australia. We host and distribute content submitted by users; we are not a publisher of third-party intellectual property and do not grant licenses to copyrighted works owned by others.

1. Acceptance of Terms

By registering an account, checking the acceptance box during signup, logging in, or otherwise accessing or using Talevo, you confirm that you have read, understood, and agree to these Terms, our Privacy Policy, and our Billing & Refund Policy (collectively, the "Policies").

If you do not agree to all Policies, you must not use the service.

We record your acceptance of the then-current terms version (including the effective date shown above) when you register or re-accept after an update. Continued use after a policy update constitutes acceptance of the updated version where permitted by law.

2. Eligibility

You must be at least 18 years old to register for or use the service.

By using the service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms in your jurisdiction.

We may request age verification or refuse service where we reasonably believe eligibility requirements are not met.

3. Service Scope

Talevo provides AI-assisted creative tools, including but not limited to: long-form fiction and novel generation; interactive adventure scripts and story progression; character and world-building utilities; AI image generation; editing, session management, and export tools; and community publishing, discovery, and moderation features.

Features, models, quotas, and availability may vary by account type, region, and product configuration. We do not guarantee uninterrupted access or that any particular feature will remain available.

AI outputs are generated probabilistically and may be inaccurate, incomplete, fictional, biased, repetitive, or unsuitable for your intended use. You are responsible for reviewing outputs before relying on them or publishing them.

4. Accounts and Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

Each natural person may maintain only one account unless we expressly authorize otherwise. You may not share, sell, rent, or transfer account access.

You must provide accurate registration information and keep it up to date. Notify us promptly if you suspect unauthorized access.

We may suspend, restrict, or terminate accounts that violate these Terms, pose security or legal risk, or harm other users or the platform. Where reasonably practicable, we will give prior notice and an opportunity to respond before termination for non-urgent matters; we may act immediately without notice for serious abuse, fraud, legal compulsion, or security emergencies.

5. User Content

"User Content" means prompts, story text, outlines, adventure scripts, characters, world settings, images, comments, feedback, and other material you submit, generate, edit, upload, or publish through the service.

You retain ownership of your User Content subject to the license below and applicable law. You represent that you have all rights necessary to submit your inputs and to grant the licenses described here.

When you publish content to community-visible areas (including public novels, chapters, adventure worlds, images, or profiles), you represent and warrant that: (a) you created the material or have all permissions needed to publish it; (b) it does not infringe copyright, trademark, privacy, publicity, or other third-party rights; and (c) you will not present third-party franchises, characters, or settings as if officially licensed by their rights holders unless you have written authorization.

Talevo does not provide or imply any license from third-party IP owners. Publishing fan-created or derivative works without rights-holder permission is at your own risk.

To operate Talevo, you grant the operator a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, format, moderate, distribute within the service, and promote your User Content solely as needed to provide, secure, and improve the service.

After you close your account, we will delete or de-identify your personal User Content within approximately 30 days, except where retention is required by law, for dispute resolution, fraud prevention, billing records, backups on natural expiry cycles, or enforcement of these Terms.

6. Prohibited Content and Conduct

You may not use the service to create, upload, publish, or distribute content or engage in conduct that:

• involves or sexualizes minors, or facilitates exploitation of children;

• is non-consensual intimate imagery, deepfakes intended to deceive or harm, or impersonation of real persons without lawful basis;

• infringes intellectual property, privacy, publicity, or other third-party rights (including unauthorized derivative works based on others' copyrighted characters, settings, or franchises);

• promotes violence, terrorism, self-harm, or illegal activity;

• constitutes harassment, hate speech, or targeted abuse;

• contains malware, attempts credential theft, or disrupts the service or its infrastructure;

• uses automated scraping, bulk extraction, or systematic harvesting of platform data, outputs, or user content without written permission;

• attempts model extraction, reverse engineering of proprietary systems, or circumvention of rate limits, credit consumption, access controls, or moderation;

• abuses payments, referrals, promotions, or creator incentive programs.

We may investigate violations and take enforcement action including content removal, feature restrictions, credit adjustments, and account termination.

7. AI-Generated Content

Outputs produced by AI features are provided for creative assistance only. We do not warrant that outputs are unique, original, factually accurate, non-infringing, or suitable for commercial publication without additional review.

Similar or identical outputs may be generated for different users given similar prompts. AI systems may reflect biases present in training data or inputs.

Before publishing, monetizing, or relying on AI-assisted content, you should independently verify accuracy, rights clearance, privacy implications, and compliance with applicable law and platform rules.

You are solely responsible for how you use, edit, combine, and publish AI-generated material.

8. Publishing, UGC, and Moderation

Talevo's community features are built around user-generated content. Public novels, chapters, adventure worlds, images, profiles, and other community-visible material are published by users, not by Talevo as rights holder.

Content may be reviewed automatically or by human moderators before or after publication. We may reject, delist, restrict distribution, label, or remove content that violates these Terms, applicable law, or community standards, or that creates operational, legal, or safety risk.

Content posted by the operator, staff accounts, or featured examples is subject to the same rules as other User Content. We do not grant users any license to third-party intellectual property merely because content appears on the platform.

Moderation decisions are made in our reasonable discretion to protect users and the service. Repeated or serious violations may result in loss of publishing privileges, suspension of creator incentives, or account termination.

9. Billing, Virtual Credits, and Creator Incentives

Certain features consume Echoes (Talevo's virtual service credits), member quotas, or paid access. Virtual credits have no cash value, are not stored-value instruments, and are governed by our Billing & Refund Policy unless law requires otherwise.

Pricing, packages, consumption rates, free quotas, and member benefits are displayed in-product and may change prospectively.

Where enabled, creator incentive programs may grant promotional free Echoes—for example, a share of paid Echoes when other users advance your publicly published adventure scripts. Such rewards are not cash, may require manual claim, are subject to eligibility and clawback rules described in the Billing Policy, and may be modified or discontinued.

If content is subject to a credible intellectual-property complaint or ongoing rights review, we may temporarily hide it from public discovery, suspend related creator incentives, or withhold unclaimed rewards until the matter is resolved.

10. Intellectual Property and Copyright Complaints

Talevo respects intellectual property rights and expects users to do the same. We act as an intermediary that hosts UGC; we do not adjudicate ownership disputes between users except as needed to enforce these Terms and applicable law.

If you believe content on the platform infringes your copyright or other IP rights, submit a notice including: (a) identification of the work claimed to be infringed; (b) identification of the allegedly infringing material and its location on the service (URL, title, or other locator); (c) your contact details; (d) a statement of good-faith belief that use is unauthorized; and (e) a statement that the information is accurate and, under penalty of perjury where applicable, that you are authorized to act on behalf of the rights holder.

Upon receiving a notice that appears complete on its face, we will review it promptly and, where appropriate, remove or restrict access to the identified material within a reasonable time (typically within several business days, sooner when operationally feasible). We may notify the affected user and request additional information.

Users whose content is removed may submit a counter-notice where required by applicable law, including a statement under penalty of perjury where applicable, identifying the removed material and explaining why restoration is appropriate. We may restore content after a reasonable review period if no court order or continuing legal basis requires otherwise.

We may terminate or restrict accounts of repeat infringers. Knowingly submitting false infringement notices or counter-notices may expose you to liability.

11. Disclaimers and Limitation of Liability

To the maximum extent permitted by law, Talevo is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted operation.

The operator is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, goodwill, data, or business interruption arising from your use of the service or reliance on AI outputs.

Where liability cannot be excluded, our aggregate liability for claims relating to the service is limited to the greater of (a) amounts you paid to us for the service in the twelve months before the claim, or (b) AUD 100, except where a higher minimum is required by law.

Nothing in these Terms excludes, restricts, or modifies rights or remedies that cannot be excluded under the Australian Consumer Law or other non-excludable consumer protections applicable to you.

12. Platform Role

Talevo is a technology platform that hosts and distributes user-generated and AI-assisted content. Except where we are the direct author of specific materials, we do not endorse, verify, or assume editorial responsibility for User Content or AI outputs, and we are not a party that grants sublicenses for third-party franchises or copyrighted works.

We act as an intermediary. Your relationship with other users is between you and those users; we are not a party to disputes arising solely from user interactions or competing ownership claims, except as needed to enforce these Terms, respond to valid legal notices, or protect the service.

Removal of content in response to a complaint does not mean we adopt the complainant's legal position, and restoration after a counter-notice does not mean we reject the complaint.

13. Indemnification

To the extent permitted by law, you agree to indemnify, defend, and hold harmless the operator from claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your User Content; (b) your breach of these Terms or applicable law; (c) your infringement or misappropriation of third-party rights; or (d) your fraudulent, abusive, or unlawful use of the service.

This indemnity does not apply to the extent a claim arises from the operator's negligence, fraud, wilful misconduct, or liability that cannot be limited under applicable law (including non-excludable consumer guarantees).

Nothing in this section requires you to indemnify the operator for claims that result primarily from our own breach of these Terms or failure to provide the service with due care, except where your conduct contributed to the claim.

14. Privacy

Our collection, use, and disclosure of personal information are described in the Privacy Policy, which is incorporated into these Terms by reference.

By using the service, you acknowledge that you have read the Privacy Policy.

15. Changes to These Terms

We may update these Terms from time to time. For material changes that are not urgently required for legal, security, or abuse-prevention reasons, we will provide at least 15 days' notice before the updated Terms take effect, for example by posting on this page, in-product notice, or email where available.

For material changes, we may require you to actively re-accept the updated Terms (for example by checking an acceptance box at login or registration) before continuing to use paid or publishing features. Urgent changes may take effect immediately when necessary to address legal obligations, security incidents, or serious abuse.

Where re-acceptance is not required and permitted by law, continued use after the effective date may constitute acceptance. If you do not agree to updated Terms, you must stop using the service and may close your account.

16. Governing Law and Disputes

These Terms are governed by the laws of Australia, without regard to conflict-of-law principles that would require application of another jurisdiction's laws.

You agree that courts of competent jurisdiction in Australia have exclusive jurisdiction over disputes arising from or relating to these Terms or the service, subject to any non-excludable rights you may have to bring proceedings elsewhere.

Before commencing formal proceedings, the parties will attempt in good faith to resolve disputes through negotiation for at least 30 days after written notice of the dispute, unless urgent injunctive relief is required.
